This Privacy Policy explains how we collect, use, store, and protect your personal information in compliance with the EU General Data Protection Regulation (GDPR), Regulation (EU) 2016/679.

1.2 Information We Collect. When you submit a project inquiry through our contact form, we collect your full name, email address, phone number, company name, service interest, budget range, and project description. We also collect standard server logs including IP address, browser type, and access timestamps for security and performance monitoring.

1.3 Purpose of Processing. Your personal data is processed exclusively for: (a) responding to your project inquiries and delivering service proposals; (b) executing contracted services and managing ongoing client relationships; (c) complying with applicable tax, accounting, and legal obligations under German commercial law; and (d) improving our website functionality through anonymized analytics.

1.4 Legal Basis. We process personal data based on: (a) your explicit consent provided via the contact form checkbox (Article 6(1)(a) GDPR); (b) the performance of a contract or pre-contractual measures at your request (Article 6(1)(b) GDPR); and (c) our legitimate interest in maintaining secure and functional digital services (Article 6(1)(f) GDPR).

1.5 Data Retention. Inquiry data is retained for 24 months from the date of submission. Contract-related data is retained for the duration of the engagement plus 10 years in accordance with German tax retention requirements (§ 147 AO, § 257 HGB). Upon expiration of the retention period, personal data is irreversibly deleted or anonymized.

1.6 Third-Party Disclosure. We do not sell, rent, or share personal information with unauthorized third-party data brokers. Data may be shared with: (a) hosting infrastructure providers operating within the EU (e.g., Hetzner, Netcup) under data processing agreements; (b) payment processors (Stripe) for transaction-related inquiries only; and (c) governmental authorities where legally mandated.

1.7 International Transfers. If you are located outside the European Economic Area (EEA), please be aware that your data may be transferred to, stored, and processed within the EEA. We ensure appropriate safeguards are in place for any cross-border transfers in compliance with Chapter V of the GDPR.

These Terms of Service govern all commercial engagements between WordCanvasWorks ("the Company"), registered at 30926 Hans-Böckler-Str. 11, Seelze, Germany, and any client or entity ("the Client") that commissions copywriting, messaging, or content strategy services. By submitting a project inquiry or accepting a service proposal, the Client agrees to these Terms in their entirety.

2.1 Scope of Services. WordCanvasWorks provides professional copywriting services including, but not limited to: landing page copy, website copywriting, email sequence copywriting, SEO blog content, PPC ad copy, brand voice guidelines, case study writing, sales collateral, and product description copywriting. The specific scope, deliverables, timeline, and investment for each engagement are defined in the written service proposal accepted by the Client.

2.2 Proposals & Acceptance. All engagements begin with a written service proposal outlining the scope, deliverables, timeline, and investment. A proposal is considered accepted upon: (a) the Client's written confirmation (email is sufficient); or (b) payment of any deposit or full investment as specified in the proposal. No work commences until acceptance is confirmed.

2.3 Payment Terms. Unless otherwise specified in the proposal: (a) full payment is due within 14 calendar days of invoice date; (b) a 50% deposit may be required for projects exceeding $1,000; (c) late payments incur a statutory interest rate of 9 percentage points above the European Central Bank base rate per § 288 BGB; and (d) all quoted prices are in USD unless explicitly stated otherwise.

2.4 Revisions. Each service package includes the number of revision rounds specified in the proposal. Additional revision rounds beyond the included amount are billed at $85/hour. Revisions must be requested within 14 calendar days of deliverable receipt; after this period, the deliverable is deemed accepted.

2.5 Intellectual Property. Upon complete settlement of all invoices for a given engagement, WordCanvasWorks assigns all worldwide intellectual property rights in the client-specific deliverables (copy, drafts, strategies, and related materials) to the Client. WordCanvasWorks retains the right to reference the engagement in portfolio materials, case studies, and marketing communications, unless the Client explicitly requests otherwise in writing.

2.6 Cancellation & Refunds. The Client may cancel an engagement at any time prior to draft delivery with written notice. In such cases: (a) any deposit paid is non-refundable to cover discovery and strategy work already completed; (b) if work has progressed beyond the deposit phase, the Client is invoiced for the proportional work completed; (c) if the Client cancels after draft delivery, the full engagement fee is due. Refund requests are handled per the Refund Policy below.

2.7 Limitation of Liability. WordCanvasWorks' total liability for any engagement is limited to the total investment paid by the Client for that specific engagement. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost revenue, or business interruption. We do not guarantee specific conversion rates, rankings, or revenue outcomes resulting from our copy.

2.8 Confidentiality. Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. WordCanvasWorks will not disclose the Client's business strategies, financial data, or unreleased product information to any third party without prior written consent.
